Welcome to Apex Dumpsters Co (“Apex Dumpsters,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at apexdumpsters.com and our dumpster rental, waste management, junk removal, and recycling services (“Services”). By renting a dumpster, requesting a quote, or using our website, you agree to these Terms.
1. About Us

2. Rental Agreement
When you book a dumpster, you enter into a rental agreement with us. You confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and that the placement location is one you are authorized to use.
2.1 Rental Period
Standard rental periods are 7 days unless otherwise agreed in writing. Additional days are billed at our then-current daily rate. If you need an extension, please contact us before your rental period ends.
2.2 Dumpster Sizes
We offer 10, 15, 20, 30, and 40-yard dumpsters. Sizes, dimensions, and weight allowances are described on our website and in your rental quote.
3. Weight Limits and Overage Fees
Each dumpster includes a specific weight allowance, which will be listed on your quote and invoice. If your load exceeds the included weight, an overage fee will apply at our posted per-ton rate. We reserve the right to weigh dumpsters at a certified scale, and the scale ticket determines final billing.
4. Prohibited Items
For safety, legal, and environmental reasons, the following items may not be placed in our dumpsters:
- Hazardous waste, including paint, solvents, oils, and chemicals
- Asbestos or asbestos-containing materials
- Tires, batteries, and propane tanks
- Refrigerators, freezers, and other appliances containing refrigerants (unless certified evacuated)
- Medical or biohazard waste
- Electronics and e-waste (unless arranged in advance)
- Liquids of any kind
- Animal carcasses or food waste in bulk
- Radioactive, flammable, or explosive materials
If prohibited items are found in your dumpster, you are responsible for any disposal fees, fines, or remediation costs we incur, and we may refuse to haul the dumpster until the items are removed.
5. Placement, Access, and Permits
You are responsible for ensuring a safe, legal, and accessible drop-off location. If the dumpster is placed on a public street or right-of-way, you may need a permit from your local municipality. You are responsible for obtaining any required permits unless we agree otherwise in writing.
You agree not to move the dumpster after delivery. Overhead obstructions such as low wires, tree branches, or awnings must be cleared before delivery.
6. Damage and Liability
You acknowledge that delivery and pickup of heavy equipment can leave marks or cause minor damage to driveways, lawns, sidewalks, or other surfaces. By approving a placement location, you accept this risk. We are not responsible for damage to:
- Driveways, asphalt, concrete, pavers, or landscaping at your chosen placement spot
- Underground utilities, irrigation systems, or septic components
- Items inside or near the dumpster placement area
You are responsible for damage caused to the dumpster beyond normal wear and tear, including fire damage, structural damage, graffiti, or loss of the unit while in your possession.
7. Payment Terms
Payment is due before or at the time of delivery unless we have agreed otherwise in writing. We accept major credit cards through a secure third-party payment processor. Overage fees, extension fees, and prohibited-item fees will be charged to the payment method on file. Past-due balances may accrue interest at 1.5% per month or the maximum rate allowed by California law, whichever is lower.
8. Cancellations and Refunds
You may cancel your order at no charge if you notify us at least 24 hours before your scheduled delivery. Cancellations made less than 24 hours in advance, or after a dumpster has been dispatched, may be subject to a trip or restocking fee. Once a dumpster has been delivered, the rental is non-refundable.
9. Service Limitations
We reserve the right to refuse service, end a rental early, or remove a dumpster without refund if we believe the contents are unsafe, the placement violates the law, or the customer is in material breach of these Terms.
10. Disclaimers
Our Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We do not guarantee specific delivery or pickup times, though we do our best to meet scheduled windows.
11. Limitation of Liability
To the maximum extent allowed by California law, our total liability for any claim arising out of these Terms or our Services will not exceed the amount you paid us for the rental in question. We are not liable for indirect, incidental, special, or consequential damages.
12. Indemnification
You agree to indemnify and hold Apex Dumpsters Co, its owners, employees, and contractors harmless from any claims, damages, or expenses arising from your use of our Services, your violation of these Terms, or your violation of any law or third-party right.
13. Dispute Resolution
Before filing any legal action, the parties agree to attempt to resolve disputes informally by contacting each other in writing. If a dispute cannot be resolved within 30 days, it will be submitted to binding arbitration in Orange County, California, under the rules of the American Arbitration Association, except that either party may seek relief in small claims court for qualifying disputes.
14. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Venue for any non-arbitrable matter will be the state or federal courts located in Orange County, California.
15. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on our website with a new “Last updated” date. Continued use of our Services after changes are posted means you accept the updated Terms.
